I was sent a email saying i had to pay 49.99 for a year of Roku service. When i told him it was free, he turned my tv off. Now it is stuck in guest mode and nothing i can do about it.
What you experienced is a known reported scam, especially placing user devices into guest mode. Usually that means the affected user somehow contacted them during the setup of the Roku device and they actually created the account so they had access.
Try performing a Factory Reset on the RokuTV. Press and hold the reset button (15-30 seconds for RokuTV) and see if that gets you to the setup screen. If so, use a completrely different email address than before and carefully follow instructions during setup. Do not contact or let anyone else setup your Roku.
As you stated, Roku is free. There is no monthly charge, and no activation fee.

@AvsGunnar is exactly right. If by some chance you can still log into your Roku user account, first change the password immediately, then you can take your TV out of Guest mode on the web page. But if you can't get logged in, the follow the advice to do a factory reset on your TV and create a new Roku user account to link it to. Don't use the same account if you don't have access to it.
By the way, there are many people who don't know a quick way to get an additional email address. So, either: 1) google the use of a + sign in an email address, or 2) Set yourself up in duckduckgo.com to have them generate unique addresses for you that will be forwarded to your existing address.
