I have a roku that was setup by my now ex wife. I want to make it mine. If I set it back to factory default and go through setup will it let me activate it or will I have a problem since she has it activated under her account.

Once its factory reset, you activate on your account by just using a different email then the ex's.

It won't tell me already activated on another account. Don't want to be stuck with dead roku and don't want to deal with her.

Once you factory reset it's practically like you just bought it.  No need to involve the ex.  I just factory reset one of my devices an hour ago.

No, it will not. 

But to do factory reset make sure you press, and hold reset button for over 30 seconds with it powered. 

You can also do it through the menu:

settings> system> advanced system settings> factory reset> follow prompts
