The CBS news app is violating the Roku settings. Roku needs to harden their code to stop this. I removed the app and the Roku is now performing properly. The problem may not actually be the fault of CBS so Roku might harden there OS to stop this problem and possibly other exploits.

I received another email, this one more helpful:

“We appreciate you reporting this issue to us. Our engineers are aware and are currently working on a fix for the CC being turned on by default on Roku devices. Be on the lookout for an updated version of our Roku app that addresses this. We apologize for any inconvenience this may have caused you and appreciate your patience as we try to resolve the issue.

The CBS News app updated to version 5.4.4 today (3/4) - check to see if this addresses the CC and other issues.
